Octavius Griffin, has commenced this Fair Labor Standards Act (FLSA) section 216b collective action lawsuit in the Middle District of Florida, Federal Court, individually and on behalf of all Project Managers (PM) and other day rate employees of Covenant Roofing & Construction Inc. for failure to pay overtime wages as required under Section 207a of the FLSA.   The case is:  Griffin, individually and on behalf of all others similarly situated v. Covenant Roofing & Construction Inc.,  Case 5:26-cv-00130.  

Griffin, like all PM, was paid on a day rate basis, and routinely suffered to work over 40 hours of work each workweek without being paid any overtime premiums or overtime wages for these additional hours. As the Complaint pleads, this is an unlawful pay practice as day pay employees are required to be paid overtime wages pursuant to the federal wage law in the FLSA.

Additionally, Griffin was required on occasions to drive long distances, far from his home which substantially increased his work time and the same resulted in the day pay being less valuable and far closer to minimum wages.

Griffin seeks to recover for himself and all other Project Managers and daily pay employees, overtime wages for all hours worked over 40 in every workweek over the preceding 3 years, plus payment of attorney’s fees, and double the sum of wages to be awarded, as liquidated damages, and reclassification to non-exempt status and an order requiring Covenant to pay overtime premiums going forward.
